Moderated by Éliane Lachaine of Burn Tucker Lachaine, this expert panel features Justices Jaye Hooper, Pierre Roger, and Marc Smith of the Superior Court of Justice. Together, they discuss key considerations and emerging trends in assessing damages in personal injury litigation.
Jaye Hooper has practiced in Ottawa since her call to the bar in 2001. Jaye has extensive trial experience as well as dozens of appearances on motions and appeals. Jaye has appeared before all levels of court including the Court of Appeal and Supreme Court of Canada. Jaye is an active member in the legal community. She served as President on the executive of the County of Carleton Law Association (CCLA) for the 2012-2013 term and continues to participate in various committees including the Federation of Law Associations (FOLA), a provincial body representing the interests of the practicing bar in Ontario. Jaye is the past Chair of FOLA. Personally, Jaye and her husband Paul have a very rich life enjoying their four children. Jaye lives in the Westboro community and has been active in local initiatives including the rebuilding of Broadview Public School.
Since January 2014, Éliane practices in her own boutique personal injury firm, Burn Tucker Lachaîne LLP, in Ottawa with partners Colleen Burn and Laurie Tucker. Her bilingual practice is focused on motor vehicle collisions, slip and fall claims and fatality claims. She attended the University of Ottawa, where she obtained her Bachelor's degree in Social Sciences in 2001 and her law degree in 2003. She articled with the law firm of Doucet McBride LLP and joined the firm as an associate until 2013. Éliane a été conférencière lors de conférences présentées par l’Ontario Trial Lawyers Association et est membre-fondatrice du comité organisateur des ateliers de plaidoirie présentés annuellement par l’Association des juristes d’expression française de l’Ontario. Éliane is the secretary of the board of directors of Centre Espoir Sophie, the only francophone drop-in centre for marginalized women in Ottawa. Outside the office, Éliane enjoys skiing (downhill, cross-country and touring) and training for triathlons with her spouse.
Tara is an associate at Williams Litigation. She has been practicing in Ottawa since her call to the bar in 2005. She represents both insurers and individuals with a focus on litigation including motor vehicle liability, slip and falls, negligence, brain injuries, product liability and Statutory Accident Benefits claims. She has regularly appeared before the Superior Court of Justice, Ontario Court of Appeal, Financial Services Commission of Ontario and the License Appeal Tribunal. Tara is an active member of Kiwanis Ottawa and volunteers her time with both the Direct Assistance Committee and the Holiday Hamper Committees. In her spare time, Tara enjoys adventure travel and spending time with her young family.
Justice Roger, from Hearst, Ontario, served as Case Management Master of the Ontario Superior Court of Justice in Ottawa from 2010 to 2015, sitting in civil and family matters. Previously, he was a partner with Borden Ladner Gervais LLP in Ottawa from 1991 to 2010, where he practised health law, insurance law, libel and defamation litigation, personal injury litigation, and professional negligence litigation. Justice Roger received a Bachelor of Commerce (Cum Laude) in 1986 and a Bachelor of Laws (Magna Cum Laude) in 1989, both from the University of Ottawa. He was admitted to the Bar of Ontario in 1991.His Honour was appointed as a judge of the Superior Court on June 26, 2015.
Marc is a founding member of Forget Smith, a boutique litigation firm. His practice focuses primarily on defending claims related to bodily injury, accident benefits, automobile, professional liability and claims related to construction. He represents local and national insurance companies as well as individual and corporate clients in other areas of litigation such as estate litigation. Marc has also developed a subrogation practice and he has been able to achieve cost-effective recoveries for his clients. Marc is fluently bilingual and he promotes access to justice for French-speaking people in the province. He is the Treasury and a member of the Board of Directors of L’Association des juristes d’expression française de l’Ontario. He is also a member of the Attorney General’s Access to Justice in French Advisory Committee, a permanent committee created to provide advice and guidance to the Attorney General regarding current issues connected to access to justice in French.
