Tax issues are what keep the sole and small firm lawyer up at night.  Issues that have crossover application into different areas are the most challenging.  This program will address tax topics that commonly intersect in family, estates, real estate, and employment law.

The issue of Taxes, both at the Provincial and Federal level on the death of a taxpayer is a minefield for both the Estate trustee of an Estate, and the beneficiaries of the Estate.

  • Without the careful consideration of those issues, such as Deemed Dispositions, principal residency, new trust rates and rollovers on the Federal side, amongst others, and joint accounts, equity and the Estate Administration Tax Act and its child, the Estate administration Tax (EAT), Estate trustees and their beneficiaries can cause great havoc.
  • I intend to highlight what Estate trustees and their counsel should be aware of when entrusted with the administration of an estate.

Shael Eisen

Shael Eisen’s practice is focused on estate and trust litigation including guardianships, power of attorney disputes and mediation.  Getting the optimal results for the client with the least amount of conflict and time is Shael’s premiere goal.

Shael has significant experience, both as a mediator and in the courtroom.  Shael often works with his clients and their cases through mediation and will proceed with litigation if satisfactory results are not forthcoming.

Shael has been a guest lecturer for the past several years in the Estates course at Osgoode Hall Law School and in addition has spoken on many occasions at Continuing Legal Education courses and seminars.

Tannis Waugh

Tannis Waugh

Tannis was called to the bar in 2003 and practices in the areas of real estate, corporate/commercial, and estate planning. In 2018, she was certified as a specialist in real estate by the Law Society of Ontario.

As a former Trustee for the Toronto Lawyers Association, Tannis has been involved in advocacy and education initiatives, most notably the moderator and presenter of continuing education programmes and writer of articles for the TLA journal. She currently sits on the education committee which is responsible for producing CPD programmes for Toronto lawyers.

She is also a member of the Condominium Sub-documents Committee of the Working Group on Lawyers and Real Estate which is responsible for producing province-wide precedent materials for condominium transactions.

Tannis is a frequent presenter for continuing legal education programmes and, in the past, has spoken on the issue of real estate, estates and ethics for the Canadian Bar Association,/Ontario Bar Association, Law Society of Upper Canada, The Commons Institute and the Toronto Lawyers Association.
