Brian is one of the founders of Foster Townsend LLP. A trailblazer at heart, Brian has been instrumental in leading the firm towards its current focus on civil litigation. His practice encompasses civil litigation including personal injury, insurance litigation, medical and professional liability, as well as wrongful dismissal, administrative and labour law. Recognizing the need to reduce or confine litigation to those situations where there is no other viable alternative, Brian has taken specific training in mediation, a central focus in alternative dispute resolution. He readily embraces negotiation, mediation and arbitration as essential tools in resolving disputes.
Brian practices law following one philosophy; resolve disputes as quickly and efficiently as possible. His style is to become familiar with both the issues and the client, discerning all aspects of each individual case. Brian works in a timely, cost-effective and positive manner, his ultimate goal
being to get people out of litigation and on with their lives. Brian lives his life as passionately as he practices law, an avid collector of motorcycles and fine art.
Shauna Powell’s practice has focused extensively on health law in the 20 years that she has been at Lerners. Shauna has significant experience providing representation to health professionals in both civil and administrative matters. She has successfully defended physicians against claims of medical negligence and has appeared as trial counsel in the Ontario Superior Court of Justice on numerous occasions and as appellant counsel before Ontario’s Divisional Court and Court of Appeal. She also provides representation to physicians in matters before the College of Physicians and Surgeons including disciplinary matters and fitness to practice hearings. Shauna has frequently appeared before the Health Professions Appeal Board and has been involved in various inquests where medical physicians have required assistance. She also assists physicians in privileging matters, which has included representation of physicians before Credentialing Committees, Medical Advisory Committees and Hospital Boards. In addition to her work with physicians, Shauna has significant experience providing representation to chiropractors in civil litigation matters. Shauna has both a Canadian and U.S. law degree.
