The Middlesex Law Association hosts this week’s webinar session presented by Kerry Rizzo, and Lou-Anne Farrell. Kerry Rizzo covers Registered Disability Savings Plans (RDSPs) and Henson Trusts, while Lou-Anne Farrell provides an update on case law.
Kerry Rizzo discusses factors that must be weighed when clients decide to set up an RDSP, a Henson Trust, or a Tax-Free Savings Account (TFSA). Kerry Rizzo explains RDSPs and Henson Trusts, their intended purpose, and gives information on the typical concerns that arise from potential applicants. She also reviews the Disability Tax Credit, who is eligible, and examples of how plans are calculated.
Lou-Anne Farrell analyzes four recent cases, Gefen Estate v. Gefen, Johnson v. Johnson, McGrath v. Joy, and Meuse v. Taylor. She shares notable developments with regards to the law on unconscionable procurement, the test for removal of estate trustees, the need for a “minimum evidentiary threshold” when challenging a will, and whether or not a suicide note can be a valid holograph will.
