Sentencing Vulnerable Populations

This Peel Law Association (PLA) webinar features the Honourable Justice David E. Harris, the Honourable Justice Sandra Martins, Aimee Gauthier, Jennifer Graham, Nakita Kelsey, and Lucy Rasmussen, as they discuss sentencing considerations for vulnerable populations. 

The Honourable Justice David E. Harris, the Honourable Justice Sandra Martins, Aimee Gauthier, Jennifer Graham, Nakita Kelsey, and Lucy Rasmussen provide best practices and tips for making sentencing submissions, particularly for youth, Indigenous people, and those with mental health or addiction issues. The presenters highlight the effects of sentencing on vulnerable populations, provide a refresher on sentencing principles, and how vulnerabilities can reduce moral blameworthiness if linked to the offence.

The presenters identify challenges in dealing with vulnerable accused individuals, including documenting vulnerabilities, and determining their impact as mitigating factors, or on the accused’s mens rea. They also cover collateral consequences, such as deportation or missed treatment, and provide resources for representing vulnerable adults that can assist in achieving appropriate sentencing conditions and outcomes.
