She provides advice to help lawyers avoid several pitfalls when dealing with an estate planning file requested by LawPro. These measures include making a detailed record of all interactions with the client, the number of meetings, when the meetings happened, and with who. Documenting the clients assets in detailed notes, and asking questions can be helpful as well.
Erin Naylor provides an update on the forms and process for prorate applications, and discusses recent changes to wills, powers of attorney, and succession law. Erin Naylor shares practice tips, including advising clients of relevant changes, updating your practice with regards to wills and POA drafting, writing former clients to invite them to review their current wills, and being alert to undue influence and capacity concerns.
