One panelist will discuss search issues and privacy interests in text messages being sent to another party, while the other panelist will discuss disclosure issues and obligations particularly in wiretap cases.

Patrick is a silver medallist and magna cum laude graduate of the University of Ottawa Law School who has been practicing at the forefront of criminal law in Ottawa for over 40 years. In 1989 he was among the first group of lawyers in Ontario to be certified by the Law Society of Upper Canada as a specialist in criminal law. He is counsel at Fasken Martineau and a member of the litigation practice group. He has represented clients in all trial and appellate courts in Ontario, and has been lead counsel in numerous major criminal trials including over 60 homicide cases. Other cases involve drug trafficking, fraud, regulatory offence and prosecutions under the Income Tax Act, the Competition Act and the Lobbying Act. He has also practiced before military tribunals, including the defence of a Canadian Airborne soldier charged with murder while deployed in Somalia – a case which received national media coverage and contributed to several changes to the military justice system. Patrick is a founding member and a past president of the Defence Counsel Association of Ottawa. He has lectured extensively at the Ontario Bar Admission Course on Criminal Procedure and related criminal topics.
Genevieve McInnes is a criminal lawyer and associate at Edelson & Friedman LLP. Genevieve joined the firm after ten years of practice with a prominent Toronto criminal law firm. She has a diverse practice that covers a wide range of criminal and regulatory matters and has appeared before the Ontario Court of Justice, the Superior Court of Justice and the Ontario Court of Appeal. Genevieve has particular experience with complex large-scale prosecutions, constitutional litigation and the defense of individuals charged with sexual assault and related offences.
Michelle O'Doherty has been at Bayne Sellar Ertel Carter since she began her articles in 2011. She was called to the bar in 2012 and has been practicing in criminal defence since that time. She completed her law degree at the University of Ottawa graduating in June 2011. Ms. O’Doherty is a Junior Director of the Defence Counsel Association of Ottawa and is involved in the planning of the Montebello Conference. Outside of law, Ms. O’Doherty plays softball and curls. She is a board member for the organization LiveWorkPlay where she has volunteered for over 5 years.
